Kylie Minogue Wins Legal Battle Against Kylie Jenner

It seems as if Kylie Jenner has lost monopoly over her first name. This is after an Australian singer Kylie Minogue won a spirited legal battle over the corporate trademark of their shared first name. This is coming at a time when Kylie Jenner has already begun using the renowned brand name ‘Kylie’ for her exclusive beauty and fashion line. But according to Global news, the U.S Patent and Trademark Office dismissed Jenner’s claim of the sole ownership and protection of the ‘Kylie’ label.

Kylie Jenner first sought protection for the name in line with various advertisement services back in April 2014 when she filed a U.S trademark application with the Office. However, KDB – the Australian business that represented Minogue – filed an opposition last year December to Kylie Jenner’s 2014 application for the exclusive rights of using the brand name ‘Kylie’. In the documents filed for the opposition bid, KDB apparently claimed that the approval of Kylie Jenner’s application would immensely water down Minogue’s already flourishing brand by confusing her audience.

At the same time, Minogue’s company also pointed out that the Australian pop star already owned several trademarks connected with the term ‘Kylie’ across a section of music recordings and entertainment services. This was long before Jenner’s beauty guru and reality TV career blossomed. For instance, Minogue currently holds a trademark for ‘Kylie Minogue Darling’ and ‘The Kylie Minogue Musical’. Minogue’s debut album – which sold over 500,000 copies worldwide and in the United States was also named ‘Kylie’. She then cemented her case by arguing that she has owned the website kylie.com since 1996. This is more than a year before Kylie Jenner was born. However, the latest word on the street is that Tyga’s girlfriend has already launched an appeal against the Monday morning ruling.

On a more interesting note, the opposition documents also slammed Kylie Jenner by referring to her as a third-rate reality TV personality whose role in Keeping Up with the Kardashians is nothing more than a supporting character to the three lead Kardashians; Kourtney, Khloe, and Kim. They also claimed that Jenner’s photographic exhibition on various social media platforms have been an object of criticism from various humanitarian factions.
